Have you been injured on the road abroad? 

If you have been involved in a road traffic accident abroad, whether as a driver, passenger or pedestrian then you may be able to claim compensation. For example, if you have been injured as a pedestrian or passenger, you may be able to claim compensation against the driver involved. 

Even if you were injured by an uninsured driver or the victim of a “hit and run” involving an untraced driver, you may still be able to succeed with a claim for compensation. For example, if you were injured in an EU country, you will normally be entitled to recover compensation from a centrally administered motor insurance bureau, which has been established to ensure that victims of road traffic accidents do recover compensation in these sorts of cases. 

It may be possible, depending on the circumstances, to bring a claim in the UK. For example, the 4th European Motor Directive allows you to submit a claim in the UK if you are injured in another EU country by a vehicle insured in an EU country. The claim is brought directly against the driver’s insurers or their claims representatives in the UK. 

In other cases, claims may be made abroad, for example against the driver or the insurer of the vehicle. In some countries, such as France, passengers, pedestrians and cyclists may have an automatic right to claim compensation for a road traffic accident, even if nobody is as fault.
