Claims
www.lawyershop.com - In civil actions personal injury damages are awarded to those that have been wrongfully injured by someone else. These damages are supposed to compensate the victim in respect to their physical, emotional, mental and financial trauma. Personal injury damages can be either compensatory or punitive. Compensatory damages usually covers the financial burden that was placed on the victim as a result of the personal injury and includes loss of wages, emotional distress and permanent disability. Punitive damages are then sometimes awarded in addition to compensatory damages if the defendant’s conduct is especially malicious and is done so to further punish and deter others from similar actions. Damages associated with personal injury are determined on a case by case basis. Pleural mesothelioma is an increasingly common type of lung cancer brought on by exposure to asbestos. When inhaled, asbestos fibers become embedded in the pleura, or outer lining of the lungs, leaving behind scarring and lesions. These lesions and scars eventually develop into full-blown pleural mesothelioma, a deadly form of lung cancer for which there is no cure. Asbestos fibers can also settle in the abdominal region, triggering the development of peritoneal mesothelioma. This type of lung cancer is equally dangerous.
Like asbestosis, both pleural and peritoneal mesothelioma generally lies somewhat dormant for years after a victim is exposed to asbestos; some patients do not show symptoms until up to 40 years or more after exposure.
These symptoms of pleural mesothelioma include:
Chronic cough
Expectorating blood
Stomach pain
Shortness of breath/ wheezing
Chronic fatigue
Weight loss
Chest pain
Mesothelioma, whether pleural or peritoneal, is, in most cases, fatal. In fact, most patients die within just two years of diagnosis. However, researchers are working hard to develop new treatments and perhaps even a cure for the disease.
Available Mesothelioma Treatments
Removal of fluid accumulation from the chest
Surgery
Chemotherapy
Radiation
Gene therapy
Photodynamic therapy
Immunotherapy
Asbestos
Asbestos is a toxic, naturally occurring mineral that was found in thousands of products - such as home and boat insulation, brake pads, and floor and ceiling tiles - through roughly 1980, when it was determined to cause a myriad of life-threatening asbestos exposure-related diseases, including asbestosis, lung cancer, and pleural mesothelioma. Researchers agree that when asbestos fibers are inhaled, they get trapped in the lungs, causing scar tissue build-up and lesions. Such tissue and lesions lead to difficult breathing, disease, and, too often, death.
In recent years, there has been an alarming increase in the number of cases of pleural mesothelioma a nd other asbestos exposure -relate d diseases, probably because many of such ailments don’t surface until years - sometimes as long as four decades - after exposure. That puts the thousands of construction workers, drywallers, shipbuilders, floor covering installers, automobile repair workers, cementers, oil refinery workers, and other laborers who worked with asbestos during its hey day - between 1940 and 1980 at serious risk for falling ill with pleural mesothelioma, asbestosis, or lung cancer in the near future.
If you have worked with asbestos, even for a short time, you may be at risk for developing asbestosis, lung cancer, or mesothelioma. Contact a mesothelioma or personal injury attorney who specializes in asbestos exposure-related diseases and mesothelioma in your area. He or she can help you obtain the compensation you deserve.
Asbestos Exposure
Despite early evidence that it was dangerous, many companies downplayed the risks of asbestos exposure, continuing to manufacture asbestos products and failing to provide employees with necessary protection. During the 1970s the US government took action by regulating and restricting the use of asbestos. However, for many, it was too late. Thousands of former workers have since developed serious, life-threatening asbestos exposure-related diseases, including asbestosis, pleural mesothelioma, peritoneal mesothelioma, and lung cancer. For these victims, there is hope. There are many qualified personal injury attorneys who are experienced in handling asbestosis, pleural mesothelioma, and asbestos exposure-related lung cancer cases. Read on to learn more and to find out if you have a case or to contact a mesothelioma attorney.
Asbestosis
Asbestosis, also called pulmonary fibrosis and idiopathic interstitial pneumonitis, is a non-cancerous lung disease caused by asbestos exposure. The disease develops when asbestos fibers become lodged in the lungs, causing inflammation and triggering the development of scar tissue. This scar tissue stiffens the lungs, making it difficult for air to flow in and out of them and ultimately, inhibiting breathing and causing a serious cough.
Asbestosis usually doesn’t surface for at least a decade after asbestos exposure, and it is often misdiagnosed as lung cancer or other diseases. If you have been diagnosed with asbestosis, you may be at increased risk for other respiratory problems and are advised to avoid further asbestos exposure and to stop smoking.
If you are a victim of asbestosis, you may be entitled to damages. Contact a personal injury attorney who specializes in asbestos exposure-related illnesses in your area to find out more information!
Lung Cancer Caused by Asbestos Exposure
Experts agree that both smoking and asbestos exposure can greatly increase your chances of developing lung cancer. If you believe you may be at risk, it is imperative that you first seek medical attention and then consult a personal injury attorney who specializes in handling pleural and peritoneal mesothelioma, asbestosis, and lung cancer cases.
Do You Have a Case Involving Asbestos Exposure?
If you have developed asbestosis, mesothelioma, or asbestos exposure-related lung cancer, you may be entitled to compensation, depending on how long ago you were exposed, where you were exposed, and where the companies you believe to be responsible currently reside.
For more information, speak with a personal injury attorney who specializes in handling cases that involve asbestos, asbestosis, pleural mesothelioma, peritoneal mesothelioma, and asbestos exposure-related lung cancer.

Linda of Las Cruces NM: On October 25, while vacationing in Puerto Vallarta, we awoke to the sounds of high winds. We were concerned when we looked out the window and saw the dark skies, waves reaching the 3rd floors of the rooms on the beach, and trees bending in half with the wind. So we went to the butlers room to see what we should do. We were told there was nothing to worry about. However, we stayed in the ‘Butlers‘ area for a while. Shortly after that, we were told to go down to the 19th floor for our safety. All of the guests of the upper floors gathered on the 19th floor, wondering what would happen next. Within a few minutes I fell on the marble floors in the hallway. Not knowing the seriousness of the fall, I tried to get up. I needed help…my friend helped me up and walked me to the bench in the hallway. I could not put weight on my leg without extreme pain. I sat there for about 30 minutes, waiting for someone from the hotel to help us. When some employees from the hotel came, I told them I needed a doctor, and they said they would be right back.
We waited. Other employees of the hotel came, and left….each time telling me they would be right back with help. 5 hours later, after all of the other hotel guests had gone to lower floors, I was still on the 19th floor waiting for assistance! When the storm had subsided, a maid from the hotel finally came by offering me a sandwich. She saw I needed help, and telephoned for a doctor. Within 5 minutes a doctor arrived, checked my condition, and telephoned for a ambulance. In the emergency room, x-rays were taken and found that my hip was broken and required immediate attention. If not operated on immediately, I would lose the use of my leg permanently. Because we were in a foreign country, my health insurance (Blue Cross and Blue Shield) was not honoured. The operation and hospital bills had to be paid up front. I was unable to work for 6 1/2 months because of this injury, losing over $30,000 in income. I then lost my job because I was unable to return to work in a timely manner.
The operation has not healed correctly, and I now walk with a permanent limp. I have spent thousands of dollars on hospital bills, doctors follow-up care, therapy, and medications. All as a result of the negligence of the Sheraton in keeping their guests safe. I have contacted the Sheraton with my complaint, and still, 1 year later, have not been successful in getting any answers or help in my situation. Linda should immediately contact the best-known, most aggressive personal injury lawyer in Albuquerque. Her injuries are serious and her losses too great for her to represent herself. http://www.consumeraffairs.com/travel/
